These Terms of Service ("Terms") govern your access to and use of Morse (accessible at morse.the-game.win), operated by Snowy Mountain Software, an assumed business name of ZYEYZ, LLC ("we," "us," or "our"). By accessing or using the service, you agree to be bound by these Terms. If you do not agree, you must discontinue use.

1. Service Description

Morse is an adaptive morse code learning game that takes players from zero knowledge to 20 WPM mastery through narrative-driven gameplay. The service includes both free and premium tiers.

2. Accounts

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorized use.

3. Free and Premium Tiers

• Free tier: Access to the first 10 Koch levels (30 missions). No account required for the tutorial.
• Premium tiers: Monthly ($4.49/month), yearly ($21.55/year), or lifetime ($29.99 one-time). Premium unlocks all 40 Koch levels and 120 missions.
• Early access pricing is grandfathered — your price will never increase as long as your subscription remains active.

4. Payments and Refunds

• All payments are processed through Stripe. By purchasing a premium plan, you agree to Stripe's terms of service.
• A 7-day money-back guarantee applies to all premium plans.
• Subscriptions may be canceled at any time. Access continues until the end of the current billing period.
• Lifetime plans are a one-time purchase and do not recur.
• We reserve the right to change pricing with reasonable notice. Price changes do not affect existing active subscriptions.

5. User Conduct

You agree to:

• Use the service only for lawful purposes
• Not attempt to gain unauthorized access to any part of the service
• Not interfere with or disrupt the operation of the service
• Not transmit harmful code or content
• Not reverse-engineer, decompile, or disassemble any part of the service

6. Intellectual Property

All content, features, and functionality of Morse — including but not limited to text, graphics, audio, software, game design, missions, and the adaptive learning engine — are the exclusive property of ZYEYZ, LLC and are protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes.

7. Your Data

You retain ownership of your personal data. Game progress, performance metrics, and account information belong to you. Upon account deletion, we will remove your data in accordance with our Privacy Policy.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, ZYEYZ, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, including but not limited to loss of data or profits.

10. Termination

We reserve the right to suspend or terminate your access to the service at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Montana, without regard to conflict of law principles.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the service after changes constitutes acceptance of the revised Terms.
